In March, I wrote a blog about the FY 2022 H-1B registration period. Basically, the H-1B program allows United Stated employers to temporarily employ international workers. The workers must fill jobs that require specialized knowledge in a particular area. Also, the worker must have bachelor’s degree or higher in the specific specialty. H-1B specialty occupations include fields such as architecture, engineering, mathematics, physical sciences, social sciences, medicine and health, education, business specialties, accounting, law, theology, and the arts. H-1B visas are good for a period of up to three years with a possible extension totally of six years.
More Random Selections
U.S. Citizenship and Immigration Services (USCIS) has determined that it still needs to select additional registrations to reach its H-1B numerical allocations. Therefore, USCIS has taken the unprecedented step of selecting additional registrations for a third time in a fiscal year. The selections took place on November 19th. Selected individuals must file their petitions between November 22, 2021 and February 23, 2022. Also, Individuals with selected registrations will have their myUSCIS accounts updated to include a selection notice, which includes details about when and where to file. Just for informational purposes, the second round took place in July.
Why the Shortfall
For FY 2022, there were 65,000 allocated slots for H-1B workers. Plus, there are exemptions for 20,000 petitions filed on behalf of beneficiaries with a master’s degree or higher from a U.S. institution of higher education. So, after taking registrations and historical data into account such as approvals, denials, and revocations, USCIS has realized there will be a shortfall.
It’s Not Too Late
This is good news for some who entered the lottery in March, and companies looking for qualified employees. However, I have heard a few stories where people lost patience and returned to their home country. That said, there are still opportunities to find employees with the requisite education and qualifications. Accordingly, it is important for employers to carefully execute the registration process. Failure to do so may disqualify the selection of your beneficiaries.
